Subject: Ensuring Transparency and Accountability in the Implementation of the Black Education Act

Dear Members of the African-American and Black Community in New Mexico,

I hope this message finds you well. My name is Devont’e Kurt Watson, and I had the privilege of being one of the original team members who helped architect and draft the Black Education Act (BEA). This landmark legislation was designed with the intent to improve the educational outcomes and opportunities for our Black and African-American students in New Mexico.

One of the key provisions in the BEA is the requirement for regular reporting on the progress and impact of the Act’s initiatives (BEA 2021 pgs. 7-8). Unfortunately, I have discovered that this crucial aspect of the law has not been met since its inception. This lack of transparency and accountability is concerning, as it hinders our ability to assess the effectiveness of the BEA and to make necessary adjustments to better serve our students.

In light of this, I have decided to take action. I intend to obtain any and all data related to the BEA for independent analysis and reporting. This effort is aimed at ensuring transparency and providing a comprehensive understanding of the current state of Black Education in New Mexico. While the Public Education Department has a mandate to execute their reporting per the law, my independent research will offer a non-governmental perspective, adding another layer of scrutiny and analysis.

Furthermore, this initiative will hopefully shed light on the current lack of reporting and archiving at the State Library and the Legislative Library. It is essential that lawmakers and the public have access to this information to better understand the unique set of challenges our Black and African-American students face.

I strongly urge the state to fulfill its obligations under the BEA for compliance and accountability. The sponsors and community that supported this effort should have been made aware of this lack of reporting. It is essential that lawmakers and the public have access to this information to better understand the unique set of challenges our Black and African-American students face.

While my efforts will not remedy the state’s non-action, they are intended to bring attention to this issue. If the state continues to neglect its obligations under the BEA, it may be necessary to consider legal action to ensure compliance.

I believe that transparency, accountability, and community involvement are key to achieving the goals set out in the Black Education Act. I am committed to this cause and will keep you updated on my progress. Your support and input are invaluable, and together, we can ensure that the BEA is fully implemented and serves our students as intended.
